It's Worth Protecting
While there is room to grow our Affordable Housing while also protecting
our Town's Historical Character and our Open Spaces, the new State Law known alternately as "40A", "40A, Section 3A", or "the MBTA Law" presents potential existential challenges
Briefly, the MBTA Multi-family Zoning requires for Manchester by the Sea to:
- Create MBTA Overlay District(s) in Town (1 District or multiple Districts)
- Minimum land area must be 37 acres
- Minimum Multi-family Unit Capacity is 559 housing units
- 40% of the required 37 acres must be within a 1/2 mile of train station
- Half of the required 37 acres (18.5) must be contiguous land
- All other MBTA Overlay Districts must be comprised of at least 5 acres of contiguous land
We believe that by working together, we can ensure that our town remains a special place for generations to come.
